Terms of Service — GuptAI

These Terms of Service ("Terms") govern your use of GuptAI ("GuptAI", "the Service", "we", "us", "our"), operated from India by the operator reachable at getdeaddictedllc@gmail.com ("Operator"). By installing, accessing, or using GuptAI — including the free self-install software, the Managed plan, or the one-time Setup service — you agree to these Terms. If you do not agree, do not use the Service.

We've kept this in plain English. Where something is legally important, we say it directly.

1. What GuptAI is

GuptAI is software that installs and runs an open-source AI model on your own computer or server (using Ollama and a community model), together with a local web chat and India-specific templates for legal, medical, and accounting work.

The core fact you should understand: the AI model and your documents run on your machine, not ours. We do not process, store, or receive your documents, prompts, or outputs on our servers. (See our Privacy Policy for the small amount of lead/account data we do hold.)

2. Plans

  • Self-Install (Free): an open install script, a community AI model, and templates. Provided as-is. No fee, and correspondingly limited support.
  • Managed (₹2,499/month, approx. $29): we handle updates, set up document search (RAG) over your files, provide support, and swap models. Recurring subscription, billed monthly, cancellable anytime (see Refund Policy).
  • Setup (₹4,999 one-time, approx. $59): a done-for-you installation and configuration on your machine, with handover. One-time fee.

We may change plan features or prices with reasonable prior notice. Price changes do not affect a billing cycle already paid for.

3. Your responsibilities

You agree to:

  • Provide accurate billing and contact information.
  • Use GuptAI lawfully and in line with your own professional, ethical, and regulatory obligations (including those of the Bar Council, medical councils, ICAI, and the DPDP Act, 2023).
  • Maintain your own hardware, backups, and security. Because the Service runs on your machine, the safety of the data on that machine is your responsibility.
  • Not resell, sublicense, or redistribute the paid components, or reverse-engineer them, except as permitted by the applicable open-source licences of the underlying components.

The open-source model and tools (e.g. Ollama and the model) are subject to their own licences. You agree to comply with those licences.

4. Professional and AI-output disclaimer

GuptAI is a tool to assist your work. It is not a lawyer, doctor, or chartered accountant, and its output is not legal, medical, or financial advice. AI models can produce inaccurate, incomplete, or outdated content ("hallucinations"). You must independently review and verify every output before relying on it or using it with a client or patient. You remain fully responsible for your professional work product.

5. Acceptable use

Do not use GuptAI to break the law, infringe others' rights, or generate unlawful content. Because the Service runs locally, you control and are responsible for how it is used on your machine.

6. Service availability and changes

The free software is provided as-is and as-available, with no uptime guarantee. For Managed plans we aim to provide timely updates and support but do not guarantee uninterrupted service. We may modify, suspend, or discontinue parts of the Service with reasonable notice; if we discontinue a paid plan, we'll provide a pro-rated refund for any unused pre-paid period where required.

7. Intellectual property

We retain ownership of the GuptAI name, templates, installer, and configuration we provide. You retain full ownership of your documents, prompts, and the outputs you generate — they're yours, and they stay on your machine. The underlying open-source model and tools remain the property of their respective owners under their licences.

8. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose.
  • We are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or business arising from your use of GuptAI.
  • Our total aggregate liability for any claim is limited to the amount you paid us in the 12 months preceding the claim (which, for free users, is zero).

Because we never receive your documents, we cannot be liable for the content, accuracy, security, or loss of data that resides on your own machine.

9. Indemnity

You agree to indemnify and hold the Operator harmless from claims arising out of your use of GuptAI, your content, or your breach of these Terms or of any law or professional obligation.

10. Termination

You may stop using the Service at any time and uninstall the software. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive (IP, disclaimers, liability, indemnity, governing law) survive termination.

11. Governing law and disputes

These Terms are governed by the laws of India. The courts of India shall have jurisdiction, subject to any applicable arbitration or consumer-protection rights you may have under Indian law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or on the website, with an updated "Last updated" date. Continued use after changes means you accept them.
